I received the court's decision a couple of days ago in the cohabitation case that I had brought against my ex-wife. I would consider it a partial victory; the agreement states that if she is found cohabitating with an unrelated male adult, the agreement is "terminated". The judge took it upon himself to modify that somewhat-he "suspended" the alimony payments. Which means that if between now and May 23, 2006 she can prove that she is no longer cohabitating, she can petition the court to have the alimony reinstated (but only until May 23, 2006). The chances of that happening are slim, but it is always a possibility.

In any event, I want to thank you for the excellent (no pun intended) work that your firm did. In the judge's brief, he mentions your video surveillance as being the deciding factor in his decision. My offer to use me as a reference still stands.

From the beginning, it was clear to the judge that cohabitation existed. Your investigation provided more then enough information. My Ex could have had a chance but she didn't deny that Mr. XX lived at the house, she just claimed that it wasn't a 'marital type" relationship. My alimony was terminated as of Sept 2006.
